1. Acceptance of Terms
By using this website or placing an order, you agree to be legally bound by these Terms of Service. OwlForge reserves the right to update or change these Terms at any time without prior notice. Continued use of the website after any changes constitutes acceptance of those changes.
2. Orders & Right to Refuse
All orders are subject to review and acceptance by OwlForge. We reserve the absolute right to refuse or cancel any order at any time for any reason, including suspected fraud, incorrect pricing, inappropriate or illegal custom artwork, or technical limitations. If your order is cancelled after payment, our only obligation is to refund the amount you paid.
3. Custom Products — Final Sale
All custom and personalized items (including designs, uploads, prints, embroidery, or any garment modifications) are final sale. No refunds or exchanges will be issued for custom products unless there is a confirmed manufacturing defect caused by us.
We are not responsible for customer errors in submitted artwork, spelling, layout, resolution, or file quality.
4. Shipping
Shipping timelines are estimates and not guaranteed. Delays caused by carriers, weather, or customs are out of our control and do not entitle the buyer to a refund. Once a package is shipped, responsibility passes to the carrier.
5. Warranty Disclaimer
Products are provided “as-is” and “as-available” without warranties of any kind. We make no guarantees regarding color accuracy, sizing tolerances, or the final look of designs on garments. Minor variations are not considered defects.
6. Limitation of Liability
To the maximum extent allowed under Quebec law, OwlForge’s total liability shall not exceed the total amount paid for the order in question.
We are not liable for:
- indirect damages, including lost profits or business opportunities
- user errors or misuse of the product
- damage resulting from improper washing or care
7. User Indemnity
You agree to indemnify and hold harmless OwlForge, its owners, employees, and partners from any claims, damages, or liabilities arising from your use of the site, misuse of products, or violation of these Terms.
8. Intellectual Property
You must have full rights to use any artwork or design you upload. By uploading, you confirm that you own or have permission to use the content. We reserve the right to reject or remove any design we consider inappropriate, offensive, or infringing on third-party rights.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Province of Québec and applicable Canadian federal law. Any disputes shall be handled exclusively in the courts of Gatineau, Québec. By using this site, you waive any right to class-action proceedings and agree to resolve disputes individually through arbitration or small claims court.
